A Breakdown of Immigration Court Branches & Proceedings

The Executive Office for Immigration Review (EOIR) is responsible for ruling on immigration cases, interpreting and administering federal immigration laws, and conducting immigration court proceedings, appellate reviews, and administrative hearings. Within the EOIR, the Office of the Chief Immigration Judge is responsible for managing the immigration courts located throughout the United States, while the Board of Immigration Appeals (BIA) conducts reviews of immigration judge decisions, and the Office of the Chief Administrative Officer rules on immigration-related employment cases.

Removal Proceedings

Removal hearings are the most common type of immigration-related court proceeding. In removal hearings, the Department of Homeland Security (DHS) charges and must prove a person is in the United States unlawfully and should be removed. If you are charged with an immigration law violation, you will be served with a Notice to Appear before an immigration judge to rule on your right to be in the United States. Grounds for deportation based on immigration violations include:
